Wisconsin Senate Passes Bill to Allow More People to Sue

A Senate bill that has just passed will allow more people to file medical malpractice lawsuits if it clears the House.

The bill allows adult children to file a lawsuit if their parent dies due to medical malpractice. It also allows the parents of an adult child to file a lawsuit if their children die due to medical malpractice. Currently, neither group  has legal standing and so cannot file a lawsuit if a relative dies due to medical malpractice.

The Democrat sponsor of the bill feels that everyone deserves their day in court while a Republican that is in opposition of the bill feels that the client pool should not be expanded when the budget is already running a deficit.

Bicycle and Train Collision Could Have Been Prevented

According to a witness at a collision between a Metropolitan Transit Authority light rail train and a bicyclist Friday, the accident was entirely preventable. Mark Vance, who was riding on the light rail at the time of the collision, said that the female bicyclist who was hit was plainly visible, yet the train conductor neither slowed down nor hit the warning horn. Metro officials appear to agree with the assessment that the accident was preventable, and said that an investigation was ongoing.

The victim, whose identity was not released, was hospitalized with possibly a broken kneecap, as well as some minor injuries.

Kirkland’s Sued Over Fall Injury

Alabama Supreme Court Reverses Decision on Injury Suit Time Limit

In a recent reversal of policy, the Alabama Supreme Court ruled that the established two-year time limit during which those suffering from toxic chemical or substance exposure were required to file suit does not begin “counting down” until symptoms actually appear. Previously, plaintiffs were forbidden to file suit until they began exhibiting symptoms of illness, but had only two years from the time of exposure to file suit. This, according to Justice Bernard Harwood, made no sense at all, since many disorders resulting from exposure to substances such as asbestos take much longer than two years to show up.
