A 55 year-old Olean, New York man is permanently paralyzed after he suffered a massive stroke in August 1998. Less than a month earlier, he had gone to the hospital where doctors faild to diagnosed a brain aneurysm in a CT scan.
A New York jury agreed with the prosecutors that the undiagnosed brain aneurysm caused the man's stroke and awarded him $5 million in 2008 and another jury in the State Supreme Court awarded him $18 million. With court-imposed interest, the hospital owes the paralyzed man $24 million.
The hospital tried to appeal the court's decision, claiming they were not given a fair trial. The New York Supreme Court Justice rejected its appeal.
