The owner of a nursing home facility is facing a negligence lawsuit from a 63 year-old resident after she alleges that an employee sexually assaulted her in 2009.
The woman suffers from expressive aphasia, a medical condition that limits her ability to speak and communicate. The employee accused of assaulting her was found not guilty after a two-day trial in 2009. Her lawyer, however, says that his exoneration does not mean the nursing home and the owner are without liability or accountability.
The owner and her facility are facing eight charges of negligence, violating the Consumer Protection Act and state regulations, as well as breach of contract.
