The budget provision that will allegedly make it harder for plaintiffs to sue producers of lead paint is now up for vote in the Wisconsin legislature’s two houses. This provision is a continuance of a legislative proposal that wasn’t passed last session, which was authored by Republican Senator Glen Grothman of West Bend.
The bill basically requires lawyers to determine exactly which companies produced the paint that caused their clients’ health problems and sue those particular companies, rather than going after the establishments that housed said paints.
According to Jeff Pitman of the Wisconsin Association for Justice, the proposed legislation would put people who have already filed lawsuits against companies whose products caused lead poisoning at a great disadvantage.
